TERMS & CONDITIONS

Payment

All Booking fees are non refundable except in the event Lexi Lu Photography completely cancels the booking without offer of rescheduling.

The package cost covers the time and talent of photographer, necessary retouching and creative editing of the package images, as determined by the photographer. By the time you have received your images all work for the service provided has been carried out therefore all pre paid packages are completely non refundable. All images are taken and individually hand edited using Lexi Lu's style of Photography so if you do not like your images unfortunately there is no refunds, re-editing or redo's for this as all work has already been carried out by the time you received your package. Rest assured this has never happened.

Lexi Lu Photography offers set packages to avoid high costs for the customer without sacrificing on quality. This cuts out viewing sessions. This is how we maintain an extremely cost effective service. You will not need to come back to the studio after your shoot other than to collect print orders/wall art orders if any.

When you book one of our prepaid packages, you are choosing to receive a specific amount of images. When we are shooting, we have this number in mind so we shoot with this intention until we have the images we think are perfect to be included in your package. This doesn’t mean that we leave any images out, we just narrow down very similar images. There is however usually a handful more of images as it is difficult to stick to a specific number due to unexpected expressions etc therefore you will be sent watermarked images including the handful more to select your final number of package images from. The client(s) will not have access to any unedited raw image files.

Cancelling/Rescheduling

Any request to reschedule within less than 48 hours of the shoot will require a new deposit to reschedule. As baby will then be older when rescheduling, I cannot guarantee that they will cooperate as well as they would under a few weeks old. If an illness or situation prevents a photo session from taking place, the client may reschedule their session at least 48 hours prior to their shoot without penalty. Should client fail to give 48 hours notice, or decide to completely cancel the shoot, the booking fee is forfeited and will not be refunded. If I am unwell the shoot would be rescheduled for your babies safety as I cannot carry out shoots with anything contagious that could be passed on to your baby. A shoot can be rescheduled once only. Where a final balance is not paid on time the shoot is cancelled with deposit forfeited.

If baby is early or overdue your slot may need to be changed if necessary which is fine. If you want to change your slot once the appointment has been confirmed after babies arrival then a new booking fee will apply. This applies to reasons out-with what is reasonable. If baby is overdue or you reschedule to a different date beyond babies planned shoot date the final payment date remains the same. If baby is early and the shoot occurs earlier than planned the final payment will be due sooner.

The Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.

For newborn sessions only, due to the uncertain prediction of an exact arrival day of your baby, certain flexibility for booking the newborn session will apply. An initial date within the first 14 days of your due date is to be booked in, however, this is subject to change depending on the exact date of birth. With no confirmation of babies arrival I have the right to release the booking to someone else. You must let us know when baby has arrived if early or if you go past your due date so that we can adjust accordingly.

Cake Smash Cancellation: If a Cakesmash is rescheduled or cancelled the cost of a new cake will be payable by the client. If the shoot is cancelled within 48 hours of the shoot a new booking fee will apply.

All deposits are Non Refundable and Non Transferable.

It is understood that the copyright of all and any photographs belongs to Lexi Lu Photography. Print release is given to any files included in the clients package. This permission allows you to make prints anywhere you like. The sole purpose being for personal use only. They can be used in a professional manner in regards to models portfolios but images not to be sold for profit without any consent from the photographer.

Releasing photographs online by the Client (i.e. Facebook, instagram or any other online channels) is allowed but do request that the photographer’s company name, Facebook Page and/or Website is tagged or mentioned along with the image.

Model release

The copyright of all photographs is owned by Lexi Lu Photography. With permission, the client, gives permission to Lexi Lu Photography to use any image from our photo session for general promotional advertising for Lexi Lu Photography. Lexi Lu Photography is entitled to use all images produced for exhibitions, editorials, digital and print marketing, publications, educational DVDs and websites, Online promotion, social media, industry competitions. This decision cannot be changed once granted.

Storage

Raw Files are deleted one week after client has received the package images. After 3 months, all edited package images will be deleted from photographer’s hard-drive, except as needed for promotional purposes, to be determined by Lexi Lu Photography at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. It is the clients responsibility to download the images correctly and check that they all open correctly before expiry of the digital download transfer(4 weeks). If you notice a technical issue with the image files Lexi Lu Photography must be made aware of this no later than 3 months of the client receiving the digital download transfer so that the issue can be fixed. Lexi Lu Photography may not be able to do this after a 3 month period if we no longer have the images. It is the clients responsibility to ensure the package images are downloaded correctly and the clients responsibility to make back up copies incase of pc/device failure. No refunds are available for lost images.

Liability

FULFILMENT OF OBLIGATIONS
Lexi Lu Photography shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations where failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury.

The Client understands and accepts that the photographic coverage will be as Lexi Lu Photography's professional expertise determines.

In the unlikely event of total photographic failure or cancellation of the contract by either party or in any other circumstances the liability of one party to the other shall be limited to the total value of the contract(The cost of the booked package) Neither party shall be liable for indirect or consequential losses.

If Client fails to read the supplied booking confirmation, and therefore fails to carry out required preparations prior to a newborn session, Lexi Lu Photography will not be held responsible for any resulting reductions in quality or quantity of images supplied.

Lexi Lu Photography is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

Children

Children must be supervised at all times by a responsible adult. Newborn shoots with siblings can last a couple of hours so please make sure they bring anything with them to keep them entertained. I'll tend to do sibling/family shots first on a newborn shoot so if needed one parent can leave with siblings that get too restless.

GIFT VOUCHERS

Gift vouchers purchased from Lexi Lu Photography are only valid for 12 months from date of purchase.

Gift vouchers cannot be exchanged for cash and are non transferable. No refunds will be given.

Delivery

Delivery of any edited digital files will be delivered within 3 weeks of the session date unless the photographer specifies otherwise.

Your personal data will not be passed on to any third parties.

CHRISTMAS SHOOTS POLICY

All novelty Christmas Mini Shoot Packages are completely non refundable. No rescheduling is available. Any lateness has to be deducted from the short shoot. If you miss the whole shoot refunds are not available as I cannot fill the missed slot. If children do not cooperate we can only do our best to get what we can within the time frame. Christmas Mini Packages are discounted set packages that do not include viewing sessions. The images needed for the package are captured with any others deleted. These set package images are edited and sent over to you to download.
